1. Purpose

 

These Terms of Use (hereinafter “Terms”) define the conditions of access and use of the ComInTime service, published by WEB&DESIGN.

ComInTime is an online software solution that enables companies and organizations to structure, plan, and manage their digital communication according to a strategic method, with or without the support of a certified expert.

 

2. Definitions

 

  • User: Any natural or legal person holding a ComInTime account.
  • Administrator: A user with management rights over a workspace (company, franchise, network, etc.).
  • ComInTime Expert: A professional accredited by WEB&DESIGN to assist users in implementing the ComInTime method.
  • Platform: The web and mobile application accessible at www.comintime.com.
  • Content: Any text, image, publication, message, data, or information entered or generated on the platform.

 

3. Acceptance of the terms

 

Access to and use of the platform imply full and unconditional acceptance of these Terms as well as WEB&DESIGN’s General Terms and Conditions of Sale (https://www.webetdesign.com/cgv).

WEB&DESIGN reserves the right to modify these Terms at any time. The applicable version is the one in effect on the date of use.

 

4. Description of the service

 

ComInTime offers:

  • A SaaS tool for managing digital communication: strategy, planning, publication, monitoring, and analysis;
  • A mobile application allowing interaction with these features on the go;
  • A measured integration of artificial intelligence (content suggestions, initial strategy proposals, editorial inspiration);
  • Optional human support provided by a certified expert.

 

ComInTime is available in several subscription plans, as well as configurations tailored to franchise networks and multi-site brands.

 

5. Access to the service

 

Access to the platform requires the creation of an account.

Each user agrees to provide accurate information and to keep it up to date.

The login credentials (username and password) are personal and confidential.

The user is solely responsible for any unauthorized use of their account.

 

6. Use of the service

 

The user agrees to:

  • Use the platform in compliance with applicable laws and regulations;
  • Refrain from infringing the rights of third parties (intellectual property, image, privacy, etc.);
  • Not misuse the tool or attempt to alter its functionality;
  • Comply with the usage guidelines provided by WEB&DESIGN where applicable.

 

The user retains ownership of all content they create. However, they authorize WEB&DESIGN to host and process this content technically for the proper operation of the service.

 

7. Artificial Intelligence features

 

The artificial intelligence integrated into ComInTime is designed to assist with thinking and writing, not to replace the user.

Generated content is provided as suggestions, which the user must review, adapt, and validate before publishing.

WEB&DESIGN cannot be held responsible for the use or consequences of such content.

 

8. Personal data

 

Data collected through the use of ComInTime is processed in compliance with the General Data Protection Regulation (GDPR).

9. Intellectual property

 

The method, interfaces, graphics, texts, logos, source code, and all components of the platform are the exclusive property of WEB&DESIGN.

Any reproduction, distribution, or modification without written authorization is strictly prohibited.

Users retain intellectual property rights over their own publications and uploaded media.

 

10. Service availability

 

WEB&DESIGN strives to ensure continuous service availability. However, temporary interruptions may occur for maintenance, updates, or technical reasons.

No compensation can be claimed in such cases.

 

11. Liability

 

WEB&DESIGN shall not be held liable for:

  • Errors or omissions in content published by users;
  • Misuse of the platform;
  • Data loss resulting from user negligence;
  • Temporary service unavailability.

 

12. Security

 

WEB&DESIGN implements technical and organizational measures to ensure data security.

Users agree not to attempt to access others’ data or disrupt the service’s operation.

 

13. Pricing and billing

 

Access to ComInTime is provided through a monthly or annual subscription, depending on the selected plan.

Prices are exclusive of taxes and may change at any time, without retroactive effect on current subscriptions.

Any started billing period remains due. Cancellations take effect at the end of the current period.

 

14. Termination

 

WEB&DESIGN reserves the right to suspend or close a user account in the event of:

  • Non-payment;
  • Serious breach of these Terms;
  • Use contrary to the law or the service’s intended purpose.

 

Users may delete their account at any time from their management interface.

Deletion results in the permanent loss of associated data after 30 days.

 

15. Third-party links and services

 

ComInTime may integrate external services (e.g., Facebook, LinkedIn, Instagram).

Users are responsible for complying with the terms of use of these third-party services.

 

16. Support and assistance

 

Technical support is available via the instant messaging interface integrated into the platform.

If subscribed, strategic guidance is provided by a certified ComInTime Expert.

 

17. Governing law and jurisdiction

 

These Terms are governed by French law.

In the event of a dispute, the competent courts shall be those within the jurisdiction of Belfort, unless otherwise required by law.
